
TERMS AND CONDITIONS FOR ACCOMMODATION
ACCOMMODATION CONTRACTS
SCOPE OF APPLICATION
Article1.
1. Agreements between the hotel and stay guest concerning the guest’s accommodations and any other related agreements will be subject to the Accommodation Conditions written herein. Decision on matters not specified herein will be based on related laws and commonly established practices.
2. Notwithstanding the provisions of the preceding clause, a special agreement may take precedence when the hotel accepts it and it does not go against law or common practices.
APPLICATION FOR ACCOMMODATION AGREEMENT
1. To apply for an accommodation agreement with the hotel, guests are required to provide the hotel with the following information.
(1) Number of Guest(s) and Name of the Guest(s)
(2) Date(s) of stay and scheduled arrival time
(3) Accommodation Charges (based, in principle, on the Basic Accommodation Charges listed in the Attached Table No.1.)
(4) a. Applicant name, address and phone number
b. Name, address and phone number of other person paying the accommodation charges
(5) Other matters that the hotel deems necessary
2. The hotel considers a new application for an accommodation agreement to have been made when a guest requests extension of his / her stay beyond the date indicated in item 2of the previous clause.
3. As part of its service to the Guest, (i) if the Hotel receives any oral or phone inquiry from a third party specifying the name of the Guest, and asking whether the Guest is staying at the Hotel and/ or is present in his or her room, or inquiring as to the length of his or her stay, the Hotel will respond to such oral or phone inquiry in kind, and (ii) if the Hotel receives any request from a third party specifying the name of the Guest to convey a message or pass on an item to the Guest, the Hotel will comply with such request. If so requested by the Guest, the Hotel shall suspend the above service and stop providing his or her personal information to any third parties. A Guest wishing to suspend such service must notify reception thereof at the time of reservation or check-in
CONCLUSION ETC. OF ACCOMMODATION AGREEMENT
Article 3.
1. An accommodation agreement may be considered official when the hotel approves the application indicated in the previous article. However, this does not apply if the hotel provides evidence of the absence of its approval.
2. When an accommodation agreement is concluded in accordance with the provisions of the previous clause, the guest is required to pay an application fee by the date specified by the hotel.
3. An application fee outlining the accommodation charges will first be provided to the guest for payment. Any situations to which articles 6 to 18 apply may involve penalty and damage compensation in this order. The remaining amount, if any, will be refunded at the time of payment made in accordance with the provisions of Article 12.
4. If a guest fails to pay the application fee indicated in the second clause by the date specified by the hotel in accordance with the provisions of the same clause, the accommodation agreement with the guest is no longer effective. However, this will apply only when the hotel informs the guest of the deadline for payment of the application fee.
SPECIAL AGREEMENTS NOT
REQUIRING PAYMENT OF AN APPLICATION FEE
Article 4.
1. Notwithstanding the provisions of the second clause of the previous article, the hotel may accept a special agreement that does not require payment of an application fee, indicated in the same clause, after conclusion of the agreement.
2. If the hotel does not require payment of an application fee as indicated in the second clause of the previous article and does not specify a deadline for payment of that fee in accepting an application for an accommodation agreement, the hotel may be deemed as accepting the special agreement indicated in the previous clause.
REJECTION OF AN ACCOMMODATION AGREEMENT
Article 5.
1. The hotel may reject an accommodation agreement if;
(1) The application fails to comply with the Accommodation Conditions.
(2) Rooms are occupied and no vacancy is available.
(3) The person intending to stay at the hotel is suspected of violating laws, public order or morals related to his / her accommodations.
(4) The person intending to stay at the hotel verbally or behaviorally causes significant disturbance to other guests and hotel staff.
(5) The person intending to stay at the hotel makes illegal demands of the hotel or its staff, or makes unreasonable demands.
(6) The person intending to stay at the hotel cannot be accommodated due to natural disaster, equipment failure or other unavoidable reasons.
(7) The person intending to stay at the hotel is too intoxicated to speak or behave normally and may disturb other guests or hotel staff.
(8) The person intending to stay at the hotel is deemed to obviously have an infectious disease or other toxic or contagious illness that could affect other guests staying at the hotel.
2. The hotel will not accommodate agreement if;
(1) The person intending to stay at the hotel is a member of an organized crime group or associated with such a group or other violence-related organization or antisocial force will be prosecuted according to Japanese criminal law.
(2) The person intending to stay at the hotel is associated with a gang or with a corporation or organization controlled by an organized crime group.
(3) The person intending to stay at the hotel belongs to a criminal organization or is associated with or is a front for a criminal group.
RIGHTS OF GUEST TO CANCEL AN ACCOMMODATION AGREEMENT
Article 6.
1. A guest may request that the hotel cancel his / her accommodation agreement.
2. If a guest cancels part or all of his / her accommodation agreement due to a cause attributable to him / her, the hotel will charge the guest a penalty in accordance.
3. If a guest fails to arrival, without notice, by 6:00 p.m, on the arrival date (or by two hour safter the expected arrival time the guest previously indicated), the relevant accommodation agreement may be regarded as having been cancelled by the guest. and full room charge will apply.
RIGHTS OF HOTEL TO CANCEL AN ACCOMMODATION AGREEMENT
Article 7.
1. The hotel may cancel an accommodation agreement if:
(1) The guest is deemed as possibly engaging in or is suspected of having engaged in an act that goes against laws, public order or morals related to his / her accommodations.
(2) The guest verbally or behaviorally causes significant disturbance to other guests and hotel staff.
(3) The guest makes illegal demands of the hotel or its staff, or makes unreasonable demands.
(4) The guest cannot be accommodated due to natural disaster or other unavoidable reasons.
(5) The guest is too intoxicated to speak or behave normally and may disturb other guests and hotel staff.
(6) The guest is deemed to obviously have an infectious disease or other toxic or contagious illness that could affect other guests staying at the hotel.
(7) The guest engages in any act that is prohibited as per the rules of the hotel.
2. The hotel will cancel an accommodation agreement if;
(1) The guest is a member of an organized crime group or associated with such a group or other violence-related organization or antisocial force.
(2) The guest is associated with a gang or a corporation or organization controlled by an organized crime group.
(3) The person intending to stay at the hotel belongs to a criminal organization or is associated with or is a front for a criminal group.
3. If the hotel cancels an accommodation agreement in accordance with the provisions of the first or second clause, the concerned guest is not charged for services etc. that he / she has not received.
REGISTRATION OF ACCOMMODATIONS
Article 8.
1. Immediately upon arrival, guests are required to fill in a registration form at the front desk, providing all of the following information.
(1) Name of stay guest, age, sex, address, telephone number and occupation
(2) Nationality, passport number, point of entry and date of entry into Japan for a nonresident of Japan
(3) Departure date and scheduled departure time
(4) Other matters the hotel deems necessary
2. If a guest intends to use travelers’ cheques, hotel vouchers, a credit card or other non-cash means to make the payment indicated in Article 12, he / she is required to show it at the time of making registration as indicated in the previous clause.
AVAILABLE HOURS OF GUESTROOMS
Article 9.
1. Rooms are available for accommodation between from 3:00 p.m. until the following day at 11:00 a.m. Any guest staying in the hotel for two or more consecutive days may use the room all day except on the arrival and departure day. Some packages involve restrictions on check-in / check-out time.
2. Notwithstanding the provisions of the previous clause, the hotel may allow the guest to use a room outside the hours specified in the previous clause. In this case the extra charges will be as follows:
(1) 30% of the room charge until 2:00 p.m.
(2) 50% of the room charge until 5:00 p.m.
(3) 100% of the room charge after 5:00 p.m.
OBSERVANCE OF RULES
Article 10.
The guest shall observe the House Regulations established by the hotel, which are posted within the premises of the hotel.
SERVICE HOURS
Article 11.
1. Details of service hours of the hotel’s facilities are written in hotel information and hotel website.
2. Service hours indicated in the previous clause may be temporarily changed due to unavoidable reasons. When this happens, appropriate action will be taken to inform the guest of the change.
PAYMENT
Article 12.
1. The accommodation charges must be paid at the front desk before the guest’s departure or when the hotel claims them, by means of cash, travelers’ cheques accepted by the hotel, hotel vouchers, credit card or certain other forms of payment.
2.Accommodation charges will be claimed even if the guest does not stay at the hotel at his / her discretion after a room was provided and became available for use by the guest.
HOTEL LIABILITY
Article 13.
1. The hotel will compensate for any damages incurred by the guest as a result of the hotel’s fulfilling or failing to fulfill an accommodation agreement or other related agreement. However, this may not apply when the damage is not deemed as attributable to the hotel.
2. The hotel has received a test certificate of fire-fighting equipment from the local fire department. To strengthen its preparedness for fire-related accidents, etc., the hotel is insured by comprehensive general liability insurance.
UNAVAILABILITY OF A BOOKED ROOM
Article 14.
1. In the event the hotel is unable to provide a guest with a room that was booked for the guest, the hotel will, based on the guest’s consent ensure that the guest can stay in other accommodations with conditions as similar to the booked room as possible.
2. Notwithstanding the provisions of the previous clause, the hotel will pay the guest compensation if it fails to recommend other accommodations. The compensation will be appropriated to the amount of damages. If the unavailability of a booked room is not due to a fault of the hotel, however the hotel will not pay compensation.
DEPOSITED ARTICLES
Article 15.
1. If an article that a guest deposits with the hotel is lost or damaged, the hotel will compensate for the damage unless it resulted from unavoidable reasons. However, if the deposited article is cash or other valuables and the guest failed to inform the cloakroom of the type and value of the article, the hotel will not be liable for any damages.
2. The hotel will not be liable for any loss of or damage to an article brought by the guest and not deposited with the hotel unless the loss or damage resulted from a willful act or a fault of the hotel. Even if the hotel is to compensate, it will not pay more than 150,000 yen for damages on an article for which the type and value were not reported by the guest. The hotel will not compensate for any damages to cash or valuables not deposited in the safety box located at the front desk.
BAGGAGE AND BELONGINGS
Article 16.
1. If the arrival of baggage precedes the arrival of the guest who possesses it, the hotel takes the responsibility for keeping it provided that the hotel was informed in advance and accepted the arrival of the baggage. The baggage will be handed to the guest upon arrival.
2. When a guest checks out and leaves his/her baggage or belongings behind, the hotel will hold the baggage / belongings for a certain period, and there after the baggage / belongings will be handled in accordance with the relevant provisions of the Lost Property Act. The baggage / belongings will either be returned to the guest or will be disposed of by the hotel. Any costs that may arise from this interaction will be charged to the guest.
3. The liability of the hotel concerning the protection or possession of any guests’ luggage or belongings will be pursuant to the provisions of the first clause of the previous article. When the first clause of this article applies, and to the provisions of the second clause of the previous article when the second clause of this article applies.
PARKING
Article 17.
The scope of liability of the hotel concerning guests’ use of its parking lot does not include management of vehicles, irrespective of whether the vehicle key is deposited with the hotel.
GUEST’S LIABILITY
Article 18.
If a guest intentionally or accidentally causes damage to the hotel, the guest will compensate the hotel for that damage.
PERSONAL INFORMATION
Article 19.
The hotel will appropriately handle all personal information provided by guests in accordance with its privacy policy.
LANGUAGE
Article 20.
These terms are provided in both Japanese and English. In case of a discrepancy between the Japanese and the English, the Japanese version will take precedence.
JURISDICTION AND APPLICABLE LAWS
Article 21.
Litigation arising from the Terms & Conditions for Accommodation Contracts will be resolved in the courts in Nagoya the hotel and in accordance with Japanese law.
Room Furnishing Items
Article 22.
Some of décor in guest rooms such as Inuyama-yaki pottery are available for purchase at Resort Centre. However, if any fixtures or décors are seemed to be damaged or removed from the guestroom, a compensation fee will be applied.
HOUSE REGULATION
Every guest is requested to observe and comply with the following regulations established by Hotel Indigo Inuyama Urakuen Garden (“The Hotel”) to maintain the quality of The Hotel and to ensure that hotel guests have a pleasant and safe stay in accordance with Article 10 of the Terms and Conditions for Accommodation Contract. If a guest does not comply with the Rules and Regulations, The Hotel may choose not to permit further use by the guest of the guest’s hotel room and other hotel facilities pursuant to Section 1 of Article 7 of said Terms and Conditions. The Hotel will not be liable to any guest or other party who suffers damage due to an accident or willful act; and in accordance with Article 18 of the Accommodation Contract, the guest will compensate the hotel for any damages.
PERSONAL POSSESSIONS AND VALUABLES
1. During your stay, to prevent the loss of your valuables, we strongly recommended that they are placed in the safety deposit boxes that are available in the guestrooms.
2. Please be aware that The Hotel is not liable for damages or compensation to guests in the case of loss, damage or theft of valuables and / or cash except under circumstances where The Hotel acknowledges responsibility.
3. Except when there is a forwarding address or specific instructions for their disposal have been received, unclaimed articles will be kept for a maximum of 3 months.
PAYMENT FOR SERVICE
1. Payment of all hotel services may be in cash, credit card, and coupons accepted by The Hotel. However, when bills are presented for payment they must be settled immediately.
2. Should guests wish to change the length of their stay, guests can contact the reception desk beforehand. Guests requesting to extend their stay are expected to pay the entire amount for the original length of stay.
3. You are requested to show your room key booklet to hotel personnel when signing for services offered by the restaurant or when requesting the use of special hotel facilities.
4. The Hotel reserves the right to request a deposit upon checking-in.
5. No checks (including personal check) will be accepted for payment or changed into currency.
REQUEST FOR GUEST’S COOPERATION
1. Please do not bring onto the premises of the Hotel any of the following:
A) Animals (with the exception of guide dogs and dog plans) or birds or any kind of pets.
B) Gunpowder, oils or other explosives or inflammables.
C) Objects emitting a strong or foul odor.
D) Illegally owned guns or swords and knives.
E) Objects of an unusually large size or in unusually large quantities.
F) Any substance or article whose possession and / or use is prohibited by Japanese law.
2. Gambling or other acts which are contrary to good morals or which cause an annoyance are strictly prohibited.
3. Without the Hotel’s prior permission, guests may not use the rooms for any other activity aside from uses intended by The Hotel.
4. The distribution or display of advertisements and sale of goods on The Hotel’s premises is prohibited without prior authorization from The Hotel.
5. Guests are reminded that unauthorized publication of photographs taken on the premises of The Hotel for business purposes is prohibited. Parties failing to adhere to this regulation may be subject to legal action.
6. Except in emergency situations, please refrain to entering any areas where guests and visitors are not permitted.
7. Except with the specific consent of either their parents or guardians, minors are not permitted to stay at this hotel unaccompanied.
SMOKING POLICY
1. Smoking is not permitted, except in the designated smoking areas. Please refrain from any other acts that could cause a fire in your room or anywhere in the hotel including smoking in your bed.
2. Smoking in guest room or other non-smoking area of the hotel will result in charges to the guest for cleaning or replacement of bedding, curtains, wallpaper and so on, as well as the cost of repairing any damage caused to the hotel and loss of revenue.
3. If a guest smokes in a non-smoking area or guestrooms, they will be responsible for compensating the hotel for any damages and cleaning fee of 50,000 yen will be charged to the guest.
ADDITIONAL INFORMATION GUESTS SHOULD BE AWARE OF
1. Guests will be charged, to the equivalent value, when the building, furniture, equipment, and / or other articles belonging to The Hotel are damaged, lost or contaminated by reasons other than inevitability.
2. Please note that a service surcharge is added to all outside telephone calls made from your room.
3. Drunken driving is strictly prohibited by the law. The Hotel will not permit Intoxicated persons from driving from the parking lots of The Hotel after drinking.
ONSEN TAX
Accommodation tax is levied to the guests staying in all hotels located in Inuyama including Hotel Indigo Inuyama Urakuen Garden as below.
Guests (Anyone over the age of 12): JPY150 per person

EMERGENCY
SAFETY AND SECURITY
1. You are requested to refrain entirely from smoking in the room.
2. You are requested to refrain from smoking except at smoking rooms and smoking areas where our hotel has stipulated. 3. Please do not engage in any activity that can result in fire.
4. To ensure a speedy and safe evacuation in the event of fire or natural calamity, you are requested to refer to the instructions posted on the inside of your room door to acquaint yourself with the location of the emergency exit closest to your room.
5. Please ensure your room door is locked upon exiting (this hotel has an automatic lock system).
6. Upon entering your room, please verify that the safety lock is set and that the door latch is in place. In the event someone seeks entry, it is strongly recommended that before opening the door you look through the peephole set into the door to ensure that the visitor is someone known to you or else is someone who can properly be identified. Please notify the front desk by pushing the ‘Emergency’ button on the phone in the event of any unusual occurrences or if any person seeking entry cannot be properly identified.
7. Please use the lobby for meeting with visitors.
8. Visitors who are unregistered guests will be refused entry to guest rooms and guest room floors.
SAFETY SYSTEM
In the event of a fire, the building sprinkler system will be activated automatically to help prevent its spread. At the same time, the Central Prevention Center will
be automatically notified. Our own fire brigade, on duty 24 hours a day, will then rush to the site to extinguish the fire. In the event of an earthquake, it is important to remember to stay calm. This hotel was built to meet Japan’s strict earthquake building codes. Remember always to stay calm, as situation may not be severe.
WHEN YOU ARRIVE
1. To ensure a speedy and safe evacuation in the event of fire or natural calamity, you are requested to refer to the instructions posted on the inside of your room door to acquaint yourself with the location of the emergency exit closest you room.
2. There is a flashlight in the night table drawer.
3. Note how to switch off your room air conditioner.
4. Please let the reception know if you require any special assistance in event of emergency.
IF YOU SHOULD SEE A FIRE
1. Report with the emergency button on the phone immediately.
2. Alert all the people nearby.
3. Evacuate your room right away. Put your shoes on and take the room key with you.
*If you notice a burning odor or see suspicious smoke, report with the emergency button on the phone.
CAUGHT IN A FIRE
1. Cover your mouth and nose with a wet towel to avoid inhaling smoke or flame.
2. Evacuate your room right away. Put your shoes on and take the room key with you.
3. Walk in a crouched position, or crawl along the wall towards the nearest Emergency staircase free of flames.
*Should the stairwell start filling with thick smoke or fire, return to your room.
It is the safest place to be.
CAUGHT IN YOUR ROOM DURING A FIRE
1. Turn off air conditioning to prevent smoke from being sucked into your room.
2. Stuff wet towels, sheets, or blankets under the door to keep smoke from entering through the space under the door.
3. Keep plenty of water in the bathtub, and have waste baskets or ice buckets at hand for containing water to quickly remoisten the wet clothes that are keeping the smoke out of your room.
4. Wait for the rescue team as calmly as possible.
IF AN EARTHQUAKE OCCURS
Stay calm, and follow these precautions and instructions:
1. Keep away from all windows.
2. Keep your head protected.
3. Turn o all appliances and pull out all electric plugs.
If you are in a public area:
1. Stay alert, and keep your head protected.
2. Remain inside the building.
3. Stay away from all windows.
*If you are in an elevator, it will stop at the nearest floor and the door will open automatically. Get o the elevator immediately.
EVACUATION PROCEDURES
1. Instructions will be broadcast. Please listen and follow the instructions carefully.
2. The hotel personnel will guide you to safety.
3. Do not use the elevators during an emergency.
4. Remember to take your room key before leaving your room.
